Allgemeine Geschäftsbedingungen für diverse Dienstleistungen
Nachfolgende allgemeinen Geschäftsbedingungen (AGB) gelten für die Durchführung jeglicher Veranstaltung unabhängig vom Veranstaltungsort. Veranstaltungen sind unter anderem: Klangretreats, Mentaltrainings, Klangschalenpraxis, Matris-Rhythmus-Therapie, Teamtrainings, Teamveranstaltungen, Workshopwochenenden, Seminare und Salons.
Michéle Victor Adamski ist verantwortlich für die Organisation und Durchführung der Veranstaltungen und sie ist keine Reiseveranstalterin oder Reisevermittlerin. Unterkünfte können in Victor’s Farmhaus oder der Umgebung unabhängig gebucht werden.

Das Mindestalter für die Buchung und Teilnahme an den Veranstaltungen beträgt 18 Jahre. Der Teilnehmer bucht die Veranstaltung über die Webseite. Der Kaufpreis ist sofort mit Buchung fällig. Die auf der Webseite angegebenen Preise sind Endpreise und beinhalten die aktuell gültige Umsatzsteuer.
1. Vertragsabschluss
Über die verbindliche Anmeldung zu Veranstaltungen per E-Mail oder durch Buchung auf unserer Seite, gehen Sie mit Michéle Victor Adamski ein Vertragsverhältnis ein.
Durch die Buchungsbestätigung kommt der verbindliche Vertrag über die Teilnahme an der jeweiligen Veranstaltung zustande und Ihr Termin ist damit reserviert. Die Reservierung für die jeweilige Veranstaltung ist erst wirksam, wenn Sie über contact@maison-victor.com eine Bestätigung per E-Mail erhalten haben.
Jeder Teilnehmer ist verpflichtet, im Bestellvorgang seine persönlichen Daten wahrheitsgemäß und vollständig anzugeben. Bei Änderungen dieser Daten, etwa der E-Mail-Adresse, des Namens, der Adresse und der Telefonnummer, bitten wir um entsprechende zeitnahe Information um eine gute Kommunikation gewährleisten zu können.
Jeder Teilnehmer hat die erforderlichen Voraussetzungen für die Teilnahme an der jeweiligen Veranstaltung in eigener Verantwortung und auf eigene Kosten zu treffen. Dies gilt insbesondere für die Buchung /etwaige Stornierung von Transport, Unterbringung und Verpflegung.
2. Leistungsumfang
Der Leistungsumfang und die Kosten ergeben sich aus der Leistungsbeschreibung der jeweiligen Veranstaltung. Änderungen im Leistungsumfang vor Ort behalten wir uns vor. Sie begründen keinen Anspruch auf anteilige Rückerstattung. Das Gleiche gilt für Leistungen, die die Teilnehmenden während Veranstaltungen aus unterschiedlichen Gründen selbst nicht in Anspruch nehmen.
3. An- und Abreise sowie Unterkunft
Die An- und Abreise sowie die Kosten hierfür sind nicht im Leistungsumfang enthalten. Bei mehrtägigen Veranstaltungen sind auch die Kosten für die Unterkunft nicht im Leistungsumfang enthalten.
4. Bezahlung
Nach Buchung ist eine sofortige Anzahlung vom gesamten Betrag auf folgendes Konto fällig:

Optional ist auch die Bezahlung mit Paypal oder Kreditkarte möglich.
5. Rücktritt durch den Teilnehmer
Der Rücktritt ist jederzeit möglich und muss durch den jeweiligen Teilnehmer per E-mail erklärt werden. Die Entschädigung wird nach dem Zeitpunkt des Zugangs der schriftlichen Stornierungserklärung des Teilnehmers in Prozent der Kursgebühr berechnet. Der Teilnehmer kann bis zum Beginn der gebuchten Veranstaltung einen Ersatzteilnehmer stellen, der in die Rechte und Pflichten des Vertrages eintritt. Der Abschluss einer Reiserücktrittsversicherung wird dringend empfohlen.
Bei Rücktritt bis 12 Wochen vor Veranstaltungsbeginn: 50% des Veranstaltungspreises
Bis 8 Wochen vor Veranstaltungsbeginn: 75%
Ab Woche 4: bei Nichterscheinen oder Veranstaltungsabbruch wird der gesamte Preis fällig.
6. Rücktritt durch den Veranstalter
Fällt eine Veranstaltung aufgrund Nichterreichen der jeweiligen Mindestteilnehmerzahl aus, werden die Teilnehmer spätestens 7 Tage vor Veranstaltungsbeginn per E-mail davon schriftlich informiert und der gesamte Veranstaltungspreis wird zurückerstattet. Weitere Ansprüche bestehen nicht.
Fällt die Veranstaltung aufgrund einer schweren Erkrankung von Michéle Victor Adamski kurzfristig aus, bieten wir einen Gutschein in Höhe der bereits geleisteten Zahlung mit einer Gültigkeitsdauer von 18 Monaten ab Absagedatum an, welcher für alle von uns angebotenen Veranstaltungen genutzt werden kann. Weitere Ansprüche bestehen nicht.
Wird im Erkrankungsfall für Michéle Victor Adamski eine kompetente Vertretung gefunden, wird das von den Teilnehmern akzeptiert und zieht keine Preisminderung nach sich.
7. Ausfall der Reise wegen höherer Gewalt
Bei Schwierigkeiten bei der Anreise – z. B. Flugausfällen, Streiks etc. bestehen keine Ansprüche gegenüber dem Veranstalter. Bitte schließen Sie für diese Fälle eine entsprechende Reiseversicherung ab.
8. Gesundheitliche Voraussetzungen der Teilnehmer
Die Daten zum gesundheitlichen Zustand einer Person, gehören zu den sensiblen personenbezogenen Daten im Sinne der DSGVO und bedürfen daher auch einem besonderen Schutz. Sie werden deshalb von uns nicht erhoben und verarbeitet. Wir möchten aber darauf hinweisen, dass Michéle Victor Adamski im Vorfeld über bestehende gesundheitliche Beeinträchtigungen bzw. Erkrankungen oder eine bestehende Schwangerschaft informiert werden sollte. Im Kurs erfolgen dann Hinweise bei den entsprechenden Übungen, ob die Übung überhaupt oder nur in Abwandlung erfolgen darf. Diese Hinweise sind für die Teilnehmer verbindlich.
Bei ernsthaften Erkrankungen ist die Teilnahme grundsätzlich nur nach ausdrücklicher Genehmigung des behandelnden Arztes möglich. Michéle Victor Adamski entscheidet im Zweifelsfall über die Teilnahme.
9. Haftungsausschluss
Eine Haftung für Körper- und Gesundheitsschäden kann nicht übernommen werden. Jeder Teilnehmer muss selbst entscheiden, ob eine Teilnahme an den Veranstaltungen mit der körperlichen und psychischen Verfassung vereinbar ist. Bitte fragen Sie ggf. vorab ihren Arzt.
Die Teilnehmer erklären mit ihrer Anmeldung, dass sie an den Übungen und allen weiteren Aktivitäten auf eigene Verantwortung teilnehmen und ausreichend versichert sind. Schadensersatzansprüche bei Sachleistungen gegenüber der Michéle Victor Adamski müssen innerhalb eines Monats nach Veranstaltungsende geltend gemacht werden. Spätere Ansprüche sind ausgeschlossen. Das gilt auch für den Fall, dass die Teilnehmer es schuldhaft versäumt haben, den Sachschaden unverzüglich vor Ort anzuzeigen.
Michéle Victor Adamski haftet für die ordnungsgemäße Erbringung der vertraglich vereinbarten Betreuung und ausschließlich für Schäden, die im Rahmen der jeweiligen Veranstaltungen durch Vorsatz oder grobe Fahrlässigkeit entstanden sind. Michéle Victor Adamski haftet nicht für Ansprüche gegenüber Fremdleistungen oder die z.B. durch Unterbringung im vertraglich vereinbarten Hotel oder Gästehaus entstehen. Hier gelten Haftungsbedingungen und Gewährleistungsansprüche der Fremdleister.
Für Verlust oder bei Beschädigung von Kleidungsstücken, sowie für Wertgegenständen, Schmuck oder Geld wird keine Haftung übernommen.
10. Verwendung von Video- und Bildmaterial
Wir behalten uns vor, Bild- und Videoaufnahmen während der jeweiligen Veranstaltung zur Verwendung und Veröffentlichung solcher Aufnahmen auf der eigenen Webseite und in eigenen sozialen Medien sowie zur Weitergabe an Kooperationspartner anzufertigen. Der Teilnehmer erklärt hiermit sein Einverständnis in Bild- und Videoaufnahmen seiner Person. Der Teilnehmer kann sein Einverständnis vor Ort vor Anfertigung der Bild- und Videoaufnahmen gegenüber der die Aufnahmen anfertigenden Person widerrufen.
11. Datenschutz
Wir versichern hiermit, dass alle an uns übermittelten Daten vertraulich behandelt und nicht an Dritte weitergegeben werden. Jeder Teilnehmer wird darauf hingewiesen, dass seine persönlichen Daten zu Bearbeitungszwecken elektronisch gespeichert werden. Die Bestimmungen des Datenschutzes werden beachtet. Der Teilnehmer erklärt sich in diesem Umfang mit der elektronischen Nutzung und Bearbeitung seiner personenbezogenen Daten einverstanden. Die Weitergabe ist unzulässig.
12. Abschlussbestimmungen
Es gilt das Recht der Bundesrepublik Deutschland.

General terms and conditions for various services
The following general terms and conditions (GTC) apply to the execution of any event regardless of the venue. Events include: Sound Retreats, Mental Trainings, Singing Bowl Practice, Matris Rhythm Therapy, Team Trainings, Team Events, Workshop Weekends, Seminars and Salons.
Michéle Victor Adamski is responsible for the organization and implementation of the events and she is not a tour operator or travel agent. Accommodations can be booked independently at Victor's Farmhouse or the surrounding area.

The minimum age for booking and participation in the events is 18 years. The participant books the event via the website. The purchase price is due immediately upon booking. The prices stated on the website are final prices and include the currently valid sales tax.
1. Conclusion of contract
Through the binding registration for events by e-mail or by booking on our site, you enter into a contractual relationship with Michéle Victor Adamski.
Through the booking confirmation, the binding contract for the participation in the respective event is concluded and your date is thus reserved. The reservation for the respective event is only effective after you have received a confirmation via e-mail at contact@maison-victor.com.
Each participant is obliged to provide his or her personal data truthfully and completely in the order process. In case of changes of these data, e.g. e-mail address, name, address and telephone number, we ask for a prompt information in order to be able to guarantee a good communication.
Each participant has to meet the necessary requirements for the participation in the respective event on his own responsibility and at his own expense. This applies in particular to the booking/cancellation of transport, accommodation and catering.
2. Scope of services
The scope of services and the costs result from the service description of the respective event. We reserve the right to make changes to the scope of services on site. They do not justify a claim for pro rata reimbursement. The same applies to services that the participants themselves do not use during events for various reasons.
3. Arrival and departure as well as accommodation
Travel to and from the event and the costs thereof are not included in the scope of services. In the case of events lasting several days, the costs of accommodation are also not included in the scope of services.
4. Payment
After booking, an immediate deposit of the total amount is due to the following account:

5. Withdrawal by the participant
The withdrawal is possible at any time and must be declared by the respective participant by e-mail. The compensation will be calculated according to the date of receipt of the written cancellation declaration by the participant as a percentage of the course fee. The participant can provide a substitute participant until the beginning of the booked event, who will take over the rights and obligations of the contract. The conclusion of a travel cancellation insurance is strongly recommended.
Cancellation up to 12 weeks before the start of the event: 50% of the event price
Up to 8 weeks before the start of the event: 75%.
From week 4: in case of no-show or cancellation of the event, the entire price will be due.
6. Cancellation by the organizer
If an event is cancelled due to non-attendance of the respective minimum number of participants, the participants will be informed of this in writing by e-mail at least 7 days before the start of the event and the entire event price will be refunded. Further claims do not exist.
If the event is cancelled at short notice due to a serious illness of Michéle Victor Adamski, we offer a voucher in the amount of the payment already made with a validity period of 18 months from the date of cancellation, which can be used for all events offered by us. Further claims do not exist.
If a competent substitute is found for Michéle Victor Adamski in case of illness, this will be accepted by the participants and will not result in a price reduction.
7. Cancellation of the trip due to force majeure
In case of difficulties with the journey - e.g. flight cancellations, strikes etc. there are no claims against the organizer. Please take out appropriate travel insurance for these cases.
8. Health conditions of the participants
The data on the health condition of a person, belong to the sensitive personal data in the sense of the DSGVO and therefore also require special protection. They are therefore not collected and processed by us. However, we would like to point out that Michéle Victor Adamski should be informed in advance about existing health impairments or diseases or an existing pregnancy. During the course, information will be given on the corresponding exercises as to whether the exercise may be performed at all or only in a modified form. These instructions are binding for the participants.
In the case of serious illnesses, participation is only possible with the express permission of the attending physician. Michéle Victor Adamski decides in case of doubt about the participation.
9. Exclusion of liability
No liability can be accepted for bodily injury or damage to health. Each participant must decide for him/herself whether participation in the events is compatible with his/her physical and mental condition. If necessary, please ask your doctor in advance.
With their registration, participants declare that they take part in the exercises and all other activities on their own responsibility and that they are sufficiently insured. Claims for compensation in kind against Michéle Victor Adamski must be made within one month after the end of the event. Later claims are excluded. This also applies in the event that the participants culpably fail to report the property damage immediately on site.
Michéle Victor Adamski is liable for the proper provision of the contractually agreed support and exclusively for damages caused by intent or gross negligence within the scope of the respective events. Michéle Victor Adamski is not liable for claims against third party services or which arise, for example, through accommodation in the contractually agreed hotel or guest house. In this case, the liability conditions and warranty claims of the third party providers apply.
For loss or damage to clothing, as well as for valuables, jewelry or money no liability is assumed.
10. Use of video and image material
We reserve the right to make picture and video recordings during the respective event for the use and publication of such recordings on our own website and in our own social media as well as for passing them on to cooperation partners. The participant hereby declares his consent to image and video recordings of his person. The participant may revoke his consent on site before the picture and video recordings are made vis-à-vis the person making the recordings.
11. Data protection
We hereby assure that all data transmitted to us will be treated confidentially and will not be passed on to third parties. Each participant is informed that his personal data will be stored electronically for processing purposes. The provisions of data protection will be observed. The participant agrees to the electronic use and processing of his personal data to this extent. The passing on is inadmissible.
12. Final provisions
The law of the Federal Republic of Germany shall apply.
